Right of withdrawal

Right of withdrawal, deadlines and sample withdrawal form for the Fakeshop AI brand protection monitoring plan – with separate notes for businesses and for consumers.

1. Scope of this notice

Brand protection monitoring (€19.99 per year) is aimed primarily at businesses and is, as a rule, entered into by traders within the meaning of § 14 of the German Civil Code (BGB). There is no statutory right of withdrawal between traders (§ 312g (1) BGB in conjunction with § 14 BGB); the following notice therefore does not apply to purely B2B contracts.

If you exceptionally enter into the contract as a consumer (§ 13 BGB) – for example as a private individual without a commercial purpose – the statutory right of withdrawal described below applies to you.

2. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract was concluded.

To exercise your right of withdrawal, you must inform us (QAD Soft, Dennis Bölling, Kreuzstr. 19, 78148 Gütenbach, Germany, email: [email protected]) by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the sample withdrawal form (section 5) for this purpose, although it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

3. Effects of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and no later than fourteen days from the day on which we received notice of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this reimbursement.

If you requested that the service (brand protection monitoring) should begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you notify us of the exercise of the right of withdrawal in respect of this contract, compared with the full scope of services provided for in the contract.

4. Early expiry for digital services and early commencement

If you order brand protection monitoring as a consumer and expressly agree that we may begin performing the service before the withdrawal period has expired, and at the same time confirm your knowledge that, by giving this consent, you lose your right of withdrawal once we have fully performed the contract, your right of withdrawal expires early as soon as we have fully performed the service (§ 356 (4) BGB). This applies accordingly to the extent that individual parts of the service qualify as a digital service within the meaning of § 327 BGB (§ 356 (5) BGB).

For a monitoring subscription with a term of one year, the service is only deemed to have been fully performed once the agreed contract term has expired. Until that point, your right of withdrawal continues to exist; if you withdraw, you only owe us the proportionate amount under section 3, paragraph 2 for the monitoring service already provided.
